AfriQuip – Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the AfriQuip website, platform, and related services ("Platform", "AfriQuip", "we", "us", or "our"). By accessing or using AfriQuip, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Platform.
1. Plain-Language Summary (Important)
This summary is provided for convenience only and does not replace the full Terms below.
- AfriQuip charges a success fee on all completed transactions
- This applies to sales resulting from listings AND buyer requests
- The success fee is payable by the seller
- The fee is the greater of R50 or 5% of the final transaction value
- The fee applies even if payment or delivery happens outside AfriQuip
- Sellers must honestly report completed transactions
- Buyers are responsible for verifying sellers and items before purchase
- AfriQuip may monitor on-platform messages to prevent fee bypassing
- Repeated abuse may result in suspension, termination, or legal action
2. Definitions
- Buyer: Any user seeking to purchase equipment or parts.
- Seller: Any user offering equipment or parts for sale.
- Listing: An item offered for sale on the Platform.
- Request: A buyer-posted request seeking specific equipment or parts.
- Transaction: Any sale, reservation, or transfer of ownership resulting from interaction on AfriQuip.
- Success Fee: The fee payable to AfriQuip upon completion of a transaction.
3. Platform Role & Disclaimer
AfriQuip is an online marketplace and facilitator only. We do not:
- Own, buy, or sell any listed items
- Act as an agent for buyers or sellers
- Guarantee the quality, legality, or condition of any item
- Guarantee that users are who they claim to be
All transactions are concluded directly between buyers and sellers.
4. Success Fees
4.1 When a Success Fee Applies
A success fee becomes payable when a transaction is concluded as a result of:
- A listing posted on AfriQuip, or
- A buyer request posted on AfriQuip, or
- Any communication, exposure, or interaction facilitated by the Platform
This applies regardless of:
- Where payment is made
- How delivery is arranged
- Whether the transaction is completed on or off the Platform
4.2 Success Fee Amount
The success fee is: The greater of R50 (fifty rand) or 5% of the final transaction value
4.3 Responsibility for Payment
- The seller is solely responsible for paying the success fee
- Buyers are not charged a success fee
5. Reporting Transactions
Sellers agree to:
- Accurately report when items are sold, reserved, or otherwise transferred
- Not falsely mark items as "sold off-platform" to avoid fees
- Provide truthful information when confirming transaction outcomes
AfriQuip may review transaction patterns to identify abuse.
6. Off-Platform Transactions & Bypass Prevention
Attempting to bypass AfriQuip fees by completing transactions privately after interacting on the Platform is strictly prohibited.
AfriQuip reserves the right to:
- Monitor on-platform messages
- Detect repeated off-platform sales
- Remove seller verification badges
- Issue invoices for unpaid success fees
- Suspend or terminate accounts
- Pursue legal recovery of outstanding fees
7. Buyer Requests
- Buyer requests are treated the same as listings for fee purposes
- If a seller responds to a request and a sale is concluded, a success fee applies
- The seller remains responsible for the success fee
8. Buyer Responsibility & Risk
Buyers acknowledge and agree that:
- They are responsible for verifying the legitimacy of sellers and items
- They must conduct their own due diligence before purchasing
- AfriQuip's verification processes are designed to reduce risk but are not foolproof
- Fraudulent or misrepresented accounts may still exist despite verification efforts
AfriQuip is not liable for losses arising from buyer decisions.
9. Listings & Requests Accuracy
Users agree that:
- Listings and requests must be accurate, truthful, and lawful
- Items must not be stolen, counterfeit, or illegally obtained
- Misrepresentation may result in immediate account suspension
10. Prohibited Items & Conduct
Users may not:
- List stolen or illegal items
- Engage in fraudulent activity
- Harass, deceive, or mislead other users
- Attempt to manipulate or exploit the Platform
11. Messaging & Monitoring
- AfriQuip provides on-platform messaging for user safety and compliance
- Messages may be monitored or reviewed to:
- Detect fraud
- Prevent fee bypassing
- Enforce these Terms
Private communication to avoid platform fees is prohibited.
12. Featured Ads & Paid Promotions
- AfriQuip may offer paid promotional features, including:
- Featured listings
- Priority placement
- Top-of-category or top-of-page ads
- Pricing and details are available on the Pricing page
- Promotional fees are separate from and in addition to any success fees
During early stages, featured listings may be displayed randomly.
13. Account Verification
Users agree to:
- Provide accurate and factual information during registration
- Submit valid documentation where required
- Update information if it changes
Providing false or misleading information may result in suspension or termination.
14. Suspension & Termination
AfriQuip may suspend or terminate accounts if users:
- Violate these Terms
- Fail to pay applicable fees
- Repeatedly bypass the Platform
- Engage in fraudulent or illegal conduct
15. Fees, Invoicing & Legal Action
- Unpaid success fees may be invoiced
- Failure to pay may result in legal recovery action
- Users are responsible for all reasonable costs associated with recovery
16. Limitation of Liability
To the maximum extent permitted by law:
- AfriQuip is not liable for losses, damages, or disputes between users
- Use of the Platform is at your own risk
17. Changes to These Terms
AfriQuip reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
18. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
